Bylaw: Disposition: Date of Disposition: Date Introduced: | 2004-2005/209__ Passed_________ March 29, 2005__ March 28, 2005 _ | | An act relating to the Election Board hearing. Be it enacted by the ASEWU Council that: SECTION 1: Purpose The purpose of this legislation shall be to provide a proper and uniform course of action for the hearing of policy violations. SECTION 2: Election Board Hearing - An election board hearing shall be open to the public and must have a quorum of members present. The members must have agreed to convene on a specific date, time and place.
- The sole purpose of the hearing shall be to determine if an election related violation occurred. This hearing shall be held prior to the start of the next regularly scheduled ASEWU Council meeting.
- The hearing date, time and place shall be posted at the same location(s) as the election results.
- After hearing public testimony, the Election Board shall recess from the open hearing to deliberate in a closed session to determine if an actual policy violation occurred. Once a decision has been made, the Board will enter back into the open hearing and announce its decision.
- Determination of an actual policy violation shall be reviewed by the Election Board in accordance with the current ASEWU bylaws 210 and 211.
