An act establishing the duties of the ASEWU Superior Court.
Be it enacted by the ASEWU Council that:

SECTION 1: Purpose

The Superior Court shall be authorized to act on all cases and controversies that arise under the ASEWU Constitution and/or bylaws.

SECTION 2: Responsibilities of an ASEWU Superior Court Justice

Superior Court Justices shall:

  1. Attend all scheduled hearings and sessions.
  2. Complete an eight (8) hour training period each academic year.
  3. Be familiar with the ASEWU Constitution, bylaws, the latest edition of Robert’s Rules of Order Newly Revised and the EWU Student Conduct Code.
  4. Complete ten (10) office hours per week (excluding finals week). At least four (4) of the ten (10) said office hours shall be spent in the ASEWU offices between the hours of 8:00 a.m. and 5:00 p.m. of any regular university day. These hours must be posted by the end of the second week of the quarter.
  5. Serve on one (1) of the following committees: Student Union Board of Control (SUBOC), Finance Committee, Service and Activity Fee, Review and Proposal, or the Residency Appeals Committee.
  6. Serve on one (1) additional standing committee of the University or of the ASEWU.
  7. Establish weekly communication with the Office of Student Rights and Responsibilities to serve as a liaison between this administrative body and student government.
  8. Conduct twice annual reviews (as per bylaw 707).

 

SECTION 3: The ASEWU Superior Court Chief Justice

In addition to the responsibilities entrusted to the Chief Justice by the ASEWU Constitution, the Chief Justice shall ensure that a Superior Court Justice attends all ASEWU Council meetings, including executive and special sessions unless otherwise stated, with speaking rights limited to:

  1. Point of Information.
  2. Point of Order.
  3. Advisement of constitutional requirements.
  4. Provide weekly reports pertaining to Court business and concerns.

The Superior Court Chief Justice shall also complete a minimum of twelve (12) office hours per week (excluding finals week). At least five (5) of the twelve (12) said office hours shall be spent in the ASEWU offices between the hours of 8:00 a.m. and 5:00 p.m. of any regular university day.

The Superior Court Chief Justice shall be responsible for conducting twice annual reviews (as per bylaw 707).

The Superior Court Chief Justice or his/her designee shall attend the weekly ASEWU Council meetings.

SECTION 4: Meetings

The Superior Court shall:

  1. Meet no less than six (6) times per quarter, excluding summer quarter.
  2. Set and post an agenda twenty-four (24) hours in advance for each Court meeting.
  3. Formally record all Court meetings in accordance to the latest edition of Robert’s Rules of Order Newly Revised and maintain a permanent file of the minutes. A copy of the minutes shall be distributed to the ASEWU Council.
  4. Conduct all Court meetings as open meetings to the public unless a deliberation (executive session) is called by a simple majority vote of the Superior Court Justices.

 

SECTION 5: Exceptions

Exceptions to the performance of responsibilities by an ASEWU Superior Court Justice shall be permitted for any of the following reasons:

  1. Illness of said member.
  2. Family emergency.
  3. Any other reason deemed excusable by a simple majority of the ASEWU Superior Court.

In the event that any of the above reasons interfere with an ASEWU Superior Court Justice’s responsibilities, he/she shall notify the ASEWU Chief Justice of the situation as soon as possible, either directly or indirectly through the ASEWU program support supervisor.

SECTION 6: Penalties

If a Justice incurs two (2) or more unexcused absences in fulfilling their stated responsibilities as outlined in this bylaw and in the ASEWU Constitution for a given quarter, the Court may vote to make the Justice inactive. When a Justice is inactive they are placed on probation and are not allowed to vote on any, issues before the Court. The Justice may become active again by regularly attending meetings and maintaining established office hours during the one (1) month probationary period. When a Justice is in inactive status, the ASEWU Council may remove the Justice by a three-fourths (¾) majority vote. A Justice will not receive salary while on inactive status.

SECTION 7: Hearing Procedures

The following procedures will be followed at all hearing procedures.

  1. Hearing procedures will follow the guidelines set forth in the EWU Student Code of Conduct and the ASEWU Constitution and bylaws.
  2. The Superior Court shall act within ten (10) business days of the formal filing of the complaint with the Chief Justice. Such action shall include, but is not limited to, taking the complaint under advisement or rendering an opinion.
  3. The Chief Justice must notify both parties of the date, time and location of the hearing.
  4. The Chief Justice must notify the defendant(s) in writing of the accusation(s) charged by the complainant at least three (3) business days prior to the hearing.
  5. The Chief Justice must make written copies of all Superior Court decisions available to the ASEWU President, Dean of Students, and all parties involved within five (5) business days of the hearing.
SECTION 8: Guidelines for Judgments and Recommendations

Requests for a judgment or recommendation must be submitted to the Chief Justice in writing. No anonymous requests will be accepted.

The Court will process all properly submitted requests in an “expeditious” manner as defined in Article I, section II, of the ASEWU Constitution.

SECTION 9: Vacancies

When a vacancy occurs on the Superior Court, the Chief Justice must report the vacancy in writing to the ASEWU Council at their next regularly scheduled meeting.

SECTION 10: Enactment

This bylaw shall become effective at the beginning of the quarter immediately following its enactment.

SECTION 11: Rescinded

Bylaw 2006-2007/701 is hereby rescinded.
